Wisp Terms of Use

Effective date: October 30, 2026

Terms version: 2026-10-30-v9

These terms are the agreement between you and Wisper Voice LLC, a South Carolina limited liability company ("we", "us"), for using the WisperVoice reading app ("Wisp" for short) and the services that run it. Please also read the Wisp Privacy Policy. Both are in the app under Settings and online at https://wispervoice.com/privacy/ and https://wispervoice.com/terms/. Questions: support@wispervoice.com.

1. Who can agree

Only a parent or legal guardian ("parent" or "you") who is at least 18 and an adult under the law where you live may accept these terms and create the parent account. You accept them by tapping I Agree when Wisp asks, for yourself and, where the law allows, for the children you add, who use Wisp under your supervision. Wisp keeps a record of each agreement, as the Privacy Policy explains. Children use Wisp through a reader profile in the parent account and do not have their own accounts. Reader profiles are for children aged 3 to 12.

Your "household" means you and the children and other grown-ups you let use Wisp through your account. You are responsible for how they use Wisp and for keeping your device, email and store accounts secure. Wisp is offered only in the United States. You confirm that you are not in a country under a US trade embargo and are not on a US government list of people who may not receive US goods or software.

2. What Wisp is

Wisp helps children practice reading at home. It reads books aloud, listens while a child reads, colors the words, answers questions about the book and, on some plans, makes new stories with online AI.

Wisp is a reading-practice helper. It is not a teacher, a tutoring service, a formal reading assessment, speech therapy or medical advice. Its word colors, progress numbers and feedback are automatic estimates that can be wrong, especially for young children, strong accents and quiet readers, and are not a basis for diagnosing, grading or placing a child. Children's screens show stars and days read; accuracy and words-per-minute figures are shown only to grown-ups. If you have a concern about your child's reading, speech or hearing, talk to a teacher or a qualified specialist.

Wisp is a computer program, not a person. Smart Wisp's answers come from an AI model on the device and can be wrong. Asked whether it is real, Wisp says it is a computer helper, not a real person. After every 3 hours of Smart Wisp use, Wisp reminds the child to take a break. If a child's question mentions hurting themselves or something dangerous, Wisp tells the child to tell a grown-up they trust.

Wisp is not a counselor, and no person watches or listens to what your child says to it. Wisp can't recognize every worry or emergency and can't call for help. If your child may be in danger, get help right away: call 911 in an emergency, call or text 988 (the Suicide & Crisis Lifeline), or call or text 1-800-422-4453 (the Childhelp National Child Abuse Hotline).

Smart Wisp's reading modes need a device that can run them. Wisp downloads large files after a grown-up agrees to these terms: about 165 to 200 MB of voices and about 700 MB for Smart Wisp. Apple or Google delivers them. Wisp asks before using mobile data, and you're responsible for your carrier's charges.

3. Your account

A parent account is required to use Wisp on every plan, including Free and Wisp Reader. You sign in with your email address, using a password or a sign-in link we email you. Another grown-up who helps care for your readers may use the grown-up parts of Wisp with your permission, and you are responsible for their use. Those parts, signing in and links that leave the app are behind the Adult Check, a short task that helps keep young children out. It does not check who you are or how old you are and does not replace a grown-up's supervision.

We may send you notices by email to your account address or in the app, and these count as being "in writing".

4. Plans

The plan sheet in the app shows what each plan includes, and the store shows the price before you buy. On paid plans, each reader starts with 10 books open, and the next 10 open each time that reader finishes 10 more different books, in any reading mode. On Wisp Reader, that means 10 books, then 20, then all 25.

If a subscription ends or you move to a smaller plan, your readers and the progress saved on your devices stay there. Backed-up progress is kept for 12 months after your last plan with backups ends and is then deleted, as the Privacy Policy explains. Features the new plan doesn't include are locked. If more readers are in use than the new plan allows, Wisp asks you to choose which ones to use; the others pause but are kept. When a plan ends, the reader last used on a device stays active there, so free reading doesn't stop.

5. Purchases, renewal and cancellation

Purchases are made and billed by the Apple App Store or Google Play under their terms, and need the Adult Check in Wisp.

6. Create a Story

Create a Story uses an online AI service (OpenAI) to write stories and paint pictures from the story cards your child picks. It may not be available yet in every version of the app. A grown-up turns it on, and a grown-up must review and approve every story and picture, behind the Adult Check, before the story joins your child's Library. AI-made stories can contain mistakes or things you don't want your child to see, so please read new stories together, and don't approve one you don't want.

Wisp Create and Wisp Family include up to 5 saved stories and up to 8 story tries each month, shared by the household. A try counts as soon as a story starts, even if it isn't approved, and new pictures use another try. Unused stories and tries do not carry over. Approved stories are saved only on your device and are locked if your plan no longer includes Create a Story.

You may keep and share your stories for personal, non-commercial use. When you share one, say that it was made with AI. Wisp's characters and story cards stay ours; words you change yourself stay yours.

7. Rules for using Wisp

You agree that you won't, and won't let anyone using your account or devices:

Good-faith security research that uses only your own account and devices, touches no one else's information and gives us a reasonable time to fix the problem is not a breach of these terms. Please report it with "Security" in the subject line.

Wisp has no chat, messaging or contact with other users. To report a safety concern or a problem with a book, story or Smart Wisp answer, email support@wispervoice.com (Settings > Contact Support opens an email to us after the Adult Check). Please don't include your child's name or what your child said.

8. Our content and your license to use Wisp

Wisp is © 2026 Wisper Voice LLC. To the extent the law gives anyone rights in them, Wisp's software, our versions of its books, artwork and characters belong to us or our licensors. Public-domain stories themselves stay free for everyone.

We give you a limited, personal, non-exclusive, non-transferable, revocable license to use Wisp on devices your household owns or controls, for your household's personal, non-commercial use. Wisp is licensed, not sold: a plan or a Wisp Reader purchase gives you this license, not ownership. WisperVoice™, Wisp™ and the Wisp character are our trademarks. If you believe something in Wisp uses your rights without permission, tell us. If you send us feedback, we may use it without paying you.

Wisp's default voice was made from a public-domain LibriVox audiobook recording by an adult reader, heavily modified. Third-party software, AI models and fonts in Wisp are used under their own licenses, including open licenses, which govern those parts. Credits and license texts are in Settings > Licenses and credits.

If you got Wisp from the Apple App Store, Apple's Standard Licensed Application End User License Agreement (the "Standard EULA", https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) applies alongside these terms. These terms are linked in the app and in Wisp's App Store listing. For Wisp from the App Store:

9. Your information and backups

Most of Wisp's information is stored only on your device and is lost if Wisp is deleted or the device is lost. Don't rely on Wisp as the only copy of anything important.

Paid features need Wisp to confirm your plan online. If the device can't check a renewal, paid access continues for 7 more days, then pauses until Wisp confirms your plan. If you have more readers than that plan allows, the reader last used on this device stays active and the others pause until a grown-up connects and chooses which reader to use.

10. Changes and availability

We may update Wisp, add or remove features or books, or stop supporting old devices. We will give you reasonable notice of important changes by email or in the app, and we won't take away a main feature of a paid plan during a period you've already paid for, unless the law or children's safety requires it. Wisp may not always be available or free of errors, and outages at Apple, Google, Supabase, RevenueCat or OpenAI can affect it. If we stop offering Wisp, we will give you reasonable notice.

We may update these terms; the version and date at the top will change. For important changes, such as changes that reduce your rights or change how disputes are handled, we will tell you by email, and Wisp will ask you to agree again in the app before you continue. Other changes take effect on the effective date, which is never earlier than the day we publish them. A change never applies to a dispute that started before it took effect.

11. Ending use

You can stop using Wisp and delete your account at any time, as the Privacy Policy explains. We may suspend or close an account if someone breaks these terms, uses Wisp for fraud, or puts children or others at risk; when we reasonably can, we will tell you first and explain why. When an account is closed, your license ends. If we close a paid account, we will tell you how to cancel the subscription and ask for a refund. Sections 8 and 12 to 15 still apply after an account is closed.

12. Disclaimers

WISP IS PROVIDED "AS IS" AND "AS AVAILABLE". AS FAR AS THE LAW ALLOWS, WE, OUR LICENSORS AND OUR SUPPLIERS DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. As far as the law allows, we don't promise that Wisp, its reading results, its answers or its AI stories will always be accurate, complete, free of errors or available, or that Wisp will suit every child. Nothing in these terms limits consumer rights that the law does not allow to be limited, or your rights under the consumer protection laws of the state where you live. If you live in Kansas, Maine, Maryland, Massachusetts, Mississippi, Vermont, West Virginia or the District of Columbia, or anywhere else the law does not allow implied warranties to be excluded, we do not exclude them, and section 13 does not limit your remedies if we break them. This section applies as written in New Jersey.

13. Limits on liability

AS FAR AS THE LAW ALLOWS, NEITHER WE NOR OUR LICENSORS AND SUPPLIERS ARE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL LOSSES (SUCH AS LOST PROFITS), OR FOR THE LOSS OF INFORMATION STORED ONLY ON YOUR DEVICE, UNDER ANY LEGAL THEORY, INCLUDING CONTRACT AND NEGLIGENCE, EVEN IF WE OR THEY WERE TOLD SUCH LOSSES COULD HAPPEN.

AS FAR AS THE LAW ALLOWS, OUR TOTAL LIABILITY FOR ALL CLAIMS ABOUT WISP, INCLUDING CLAIMS FOR NEGLIGENCE, IS LIMITED TO THE GREATER OF WHAT YOU PAID FOR WISP IN THE 12 MONTHS BEFORE THE CLAIM OR US$100.

These limits do not apply to liability for fraud, gross negligence, willful or reckless conduct, or death or personal injury caused by negligence, or to damages, fees or penalties awarded under a statute, and they don't limit anything else that the law doesn't allow to be limited.

14. Problems and disputes

If you have a problem, please contact us first so we can try to fix it. Before either of us goes to court, the side with the problem will email the other and wait 30 days to try to settle it; as far as the law allows, any deadline to bring the claim is paused during those 30 days. This step doesn't apply to small-claims court or to asking a court to stop harm right away. These terms don't require arbitration.

These terms, and any dispute about Wisp, are governed by the laws of the State of South Carolina and US federal law, without regard to conflict-of-law rules. The consumer protection laws of the state where you live still apply to you. You may bring a claim in the state courts in Charleston County, South Carolina, in the United States District Court for the District of South Carolina, in small-claims court, or anywhere else the law allows.

15. General

If part of these terms can't be enforced, it will be changed only as much as needed, and the rest still applies. If we don't enforce a term right away, we can still enforce it later. You can't transfer your account. We may transfer these terms to a company that takes over Wisp, which must follow them. We aren't responsible for delays caused by events beyond our reasonable control. These terms, the price and renewal terms the store shows when you buy, the store's purchase terms and, for the App Store, the Standard EULA are the whole agreement about Wisp. No one else has rights under these terms, except Apple and its subsidiaries as section 8 explains.
